This Privacy Policy (this “Policy”) describes how ITV America Inc., including its parent, subsidiaries, affiliates and assigns (collectively, “ITV”, “we”, “us”, or “our”) collect, use and share your personal information in connection with your use of our website located at https://www.itv-america.com or any other websites, pages, features, mobile applications, content, or digital services that link to this Policy (the “Services”). This Privacy Policy also describes the rights and choices you have in relation to our processing your personal information.
We encourage you to read this Policy carefully to understand how we handle your personal information. By using our Services, you agree to the collection, use and disclosure of your personal information in accordance with this Policy, and you agree to the accompanying Terms of Use (“Terms”). Our Terms govern the use of our Services, and together with this Policy, constitute your agreement with us. If you disagree with or uncomfortable with any part of this Policy or our Terms, please immediately discontinue access or use of our Services.
We may change this Policy from time to time and we will notify you by revising the “Last Updated” date at the top of this Policy. If we change this Policy in a way that we believe materially affects how we process your personal information, we will provide you with advance notice such as via email or by posting a notice on our Services. Unless otherwise required by laws in your area of residence, your continued access or use of our Services after receiving the notice of changes constitutes your acknowledgment that you accept the updated Policy.
We may also provide “just-in-time” disclosure or additional information about our information collection, use, and sharing practices of specific Services. These notices may supplement or clarify our privacy practices or provide you with additional choices about how we process your personal information.
1. INFORMATION WE COLLECT
We may collect certain personal information about you and your use of our Services. Personal information is typically data that identifies an individual or relates to an identifiable individual, such as your name, email address, and phone number. The definition of personal information depends on the applicable law based on your physical location. Only the definition that applies to your physical location will apply to you under this Policy.
The personal information we collect from you in providing the Services falls into three primary categories: information you voluntarily provide to us, information we collect from you automatically, and information we collect from third parties.
Information you voluntarily provide to us. We, or service providers that assist us in providing, maintaining, and operating our Services, may collect the following types of personal information from you:
Forms. We may collect your name, email, and phone number when you would like for us to contact you. If you provide contact information, we may contact you to clarify your comment or question, or to learn about your level of interest in, or satisfaction with our Services.
Registration Information. When you register for certain Services, complete an application form, enter contests, giveaways, or competitions, attend one of our events, participate in sweepstakes or promotions, or respond to market research surveys that we sponsor, we may collect the information you provide, such as your name and email address.
Information You Post on Our Services. We may collect information when you post comments or other content to our Services, which may include your username or screenname, comments, likes, interests, status, pictures, and references to your online presence.
Your Correspondence and Your Feedback About Our Services. We collect information you provide when you contact us directly or directly provide to us feedback, comments, or suggestions on our Services.
Information You Provide When You Do Business With Us. If you are a vendor, service provider, or business partner of ITV, we may collect information about you and the services you provide, including your or your employees’ business contact information and other information you or your employees provide to us as part of the services you may provide and our agreement with you.
Other information. We also collect information that relates to or is capable of being associated with you, such as passwords, personal preferences and interests, age, gender, and any other information you choose to provide.
Career Information. When you apply to join our team, we may collect your first and last name, email address, phone number, home address, start date, and any employment-related information contained in your resume/CV or that you otherwise submit to us.
Information we collect automatically
Usage Data. When you browse our Services, we may automatically collect log data such as your web request, Internet Protocol (“IP”) address, browser type, domain names, referring and exit pages and URLs, pages viewed and the order of these page views, the date and time you access our servers, and other diagnostic data.
Device Information. When you use your desktop or mobile devices to access our Services, we may be able to identify your device’s unique device identifier, MAC address, operating system, and your mobile device’s advertising ID.
Location Information. When you use our Service, we may infer the generic physical location and geographic regions of your device from your Wi-Fi, Bluetooth and other device settings. For example, your IP address may indicate your general geographic region. Upon your permission, we may collect your mobile device’s precise geo-location. You may choose not to share your location details with us by adjusting your mobile or desktop device’s location services settings. Information from third parties
From time to time, we may obtain information about you from third-party sources, including:
Social Media Platforms and Networks. If you interact with us on social media or use features, such as plugins, widgets, or other tools made available by social media platforms or networks (including Instagram, Facebook, Twitter, Google, YouTube, and Pinterest) in connection with our website or Apps, we collect information that you share with us, or that the social media platforms share with us. From Other Sources. We may obtain information about you from other sources, such as data analytics providers, marketing or advertising service providers, vendors that provide services on our behalf, or publicly available sources.
This information helps us to update, expand and analyze trends, identify new customers, and provide content and services that may be of interest to you.
2. HOW WE USE YOUR INFORMATION
· To Provide You With Our Services. We may use your information to complete the transactions you request and perform our contractual obligations with you or to ensure that our Services function properly.
· To Provide Customer Support or Respond to You. We collect any information that you provide to us when you contact us. Without your personal information, we cannot respond to you or ensure your continued use and enjoyment of the Services.

· To Maintain the Safety and Security of our Services. We may process your information to protect the rights and property of ITV and others and to comply with our legal obligations, including to detect, investigate, and prevent fraud and other illegal activities and to enforce our agreements.
· For Marketing Purposes. We may use your personal information to send promotional messages and newsletters such as via email, text messaging, or push notifications. These might be our own offers or products or third-party offers or products we think you might find interesting. · To Improve Our Services. We may use your information to monitor and improve the operation, delivery, and general accessibility on our Services, identify popular areas or features, and optimize and personalize the Services. This may also include conducting internal research and development of our Services.
· To Maintain Legal and Regulatory Compliance. Our Services are subject to certain laws and regulations which may require us to process your personal information. For example, we process your personal information to ensure compliance with employment and recruitment laws or as necessary to manage risk as required under applicable law. Without processing your personal information for such purposes, we cannot perform the Services in accordance with our legal and regulatory requirements.
· To Enforce Compliance With Our Terms, Agreements, and Policies. When you access or use our Services, you are bound to our Terms. To ensure you comply with them, we process your personal information by actively monitoring, investigating, preventing, and mitigating any alleged or actual prohibited, illicit, or illegal activities on our Services. · With ITV companies for the purposes described in section 2, above.
· With reputable partners in whose products or services we think you may have an interest, subject to the applicable law.
· With unaffiliated companies or individuals we hire or work with that provide us with professional advice, business support, or perform services on our behalf, including customer support, web hosting, information technology, payment processing, event providers, direct mail and email distribution, contests, sweepstakes, giveaways and promotion administration, and analytics services. These service providers are allowed to use your information to help us provide our Services and not for any other purpose.
· With third parties, such as partners working with us on co-branded Services or events. Our partners use your personal information as described in their privacy policies.
· When we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, or to comply with the applicable law or legal process, or to respond to legal claims.
· In connection with a corporate change including a merger, acquisition, or sale of assets
· For contests, giveaways, sweepstakes, or promotions to verify your entry into and eligibility to participate, and to inform you if you have won.
· To any other party with your prior consent to do so.
We may combine all the information we collect from or receive about you for the outlined purposes. We may aggregate or deidentify your information and may use, share, rent, or sell aggregated or deidentified information for any purpose, and such information is not subject to this Policy.
4. HOW WE PROTECT YOUR INFORMATION
The security of your personal information is important to us. We maintain advisors, potential transactional partners, or other third parties designed to guard and prevent misuse of your personal information. Our security measures include generally accepted physical, technical, and administrative measures to prevent unauthorized access to or disclosure of your personal information, to maintain data accuracy and ensure the appropriate use of your personal information, and to otherwise safeguard your personal information.
Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. We cannot guarantee the security of our databases or the databases of the third parties with which we may share such information, nor can we guarantee that the information you supply will not be intercepted while being transmitted over the Internet. 5. HOW LONG WE KEEP YOUR INFORMATION
We will retain your information for as long as needed to provide our Services to you, to comply with our legal obligations, to resolve disputes, and to enforce our agreements and policies. We will cease to retain your personal information or remove the means by which the information can be associated with you as soon as it is reasonable to assume that such retention no longer serves the purpose for which the personal information was collected and is no longer necessary for legal or business purposes.
6. LINKS TO THIRD PARTY SITES
Our Services may include links to other sites, products, or services that we do not own and are not operated by us, and whose privacy practices may differ from those of ITV. If you click a third-party link, you will be directed to that third party’s site. If you submit personal information to any such third party sites or otherwise submit personal information to such third parties, your information is governed by the pertinent third party’s privacy policies. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services, and this Policy does not apply to your activities on any third-party sites or services or any information you otherwise disclose to any third parties. We encourage you to carefully read the privacy policy of any site you visit.
7. CHILDREN
Our Services are not directed to and we do not knowingly collect or attempt to collect any personal information from children under the age of 16. If you are under 16, please do not attempt to fill out our forms or send any personal information about yourself to us. To the extent we are capable of identifying and become aware that a child under 16 has provided us with personal information, we will terminate the user’s access to our Services and take steps to delete such information from our systems, unless we have a legal obligation to keep it. If you feel that we have unknowingly collected information from someone under the age of 16, please contact us immediately so that we can take the necessary steps to remove this information.
8. YOUR CHOICES AND RIGHTS
You have certain choices and rights as to how we use your personal information.
Access and Update Personal Information. We rely on you to access, update, and correct your personal information. Please note that we may keep historical information in our backup files as permitted by applicable law. We will take reasonable steps to verify your identity, including authenticating you through the email address you use to contact us. We may require further documentation such as a password and user ID before granting access to your information.
Email and Newsletter Preferences. You may choose to stop receiving newsletters, updates or marketing emails from us by following the unsubscribe instructions included in such emails.
Cookies and Other Tracking Technologies. We and our business partners use cookies and other technologies such as web beacons to keep track of your visits, preferences, and profile information. This information is used to make our Services easier to use, improve our advertising, and provide you with a more personal and convenient experience. For example, we may use this information to store some of your preferences or to provide you with tailored advertisements related to your specific interests on our Services. 9. NOTICE FOR CALIFORNIA RESIDENTS
This section applies only to California residents, and provides information about our data collection practices and your privacy-related rights under California law. Your “right to know” about the personal information collected, used, and disclosed by ITV includes what categories of personal information we collect from you and the purpose for its collection; how we use those categories of personal information; and how we share the personal information you entrust to us. In addition to the information provided above regarding the categories, sources, uses, and sharing of personal information we collect, we are providing the following additional information to California residents consistent with applicable law.
We collect the information described above in Section 1, including identifiers, commercial information, internet or other electronic network activity, and geolocation data, from visitors, consumers, business partners, other applications (e.g., social networks), advertising networks, and digital service providers. We may use this information for any of the business purposes described above in Section 2. We may also share this information with the categories of third parties identified in Section 3, including affiliated companies, artists, advertising networks, digital service providers, and other business partners for such business purposes. In addition to the sources and categories of third parties mentioned above, we also may share this information with law enforcement and professional service companies for the limited purposes of addressing our compliance and legal obligations and exercising our legal rights.
California Consumer Rights
Subject to certain exceptions, California residents have the following rights:
(i) Right to Know. You have the right to request a report showing the personal information collected, shared, and sold about you in the past 12 months.
(ii) Right to Deletion. You have the right to request that we delete any personal information collected from you. To the extent permitted by applicable law, we may be required to retain some of your personal information, and certain personal information is strictly necessary to fulfill the purposes described in this Policy.
(iii) Right to Opt Out of Sale of Your Personal Information. You have the right to opt out of the sale of your personal information to third parties. ITV does not sell any personal information.
(iv) Right to Non-Discrimination. We shall not discriminate against you for exercising any of the above rights.
You or your authorized agent may submit a request to exercise any of the above rights by contacting us at itvus_privacyteam@itv.com, and putting “CCPA Rights Request” in the subject line. We may require additional information to verify your identity or to verify that your authorized agent has the authority to make the request on your behalf before responding to a CCPA rights request.
If you are a California resident, you have the right to request: (a) information identifying any third party(ies) to whom we may have disclosed, within the preceding calendar year, your personal information for that third party’s direct marketing purposes; and (b) a description of the categories of personal information disclosed.
